Will of Thomas Abraham. A retired Captain from her Majesty’s Army of Frimley, Surrey Prob 11/2057

 

I, Thomas Abraham of Chapel House Frimley in the County of Surrey do hereby make this my last will and testament as follows I wish to be buried at Sandhurst in the county of Berkshire in the same grave as the remains of my late beloved wife Louisa Susannah Abraham provided that I should be sufficiently near that place at the time of my decease to allow of it being done without incurring any great expense it being my earnest desire that no unnecessary expense may be bestowed upon my funeral I request that all my just debts may be discharged as soon after my decease as may be convenient none of magnitude I hope I do give and bequeath to my children Louisa Mitty Murray widow of the late Honourable Leveson GK Murray Thomas Edward Abraham and Charles John Abraham to be equally divided between them whatever money or property of any other description that I may be possessed of and I do hereby nominate constitute and appoint my son Thomas Edward Abraham of Balliol College Oxford and my son Charles John Abraham of Kings College Cambridge Executors of this my last will and testament whereof I do hereunto set my hand and seal this first day of June in the year of our Lord one thousand eight hundred and thirty five – Thos Abraham LD – witness W. This is a codicil to the last will of me Thomas Abraham Esq whereas at the time of the marriage of my daughter Louisa the property subject to the trusts of my marriage settlement consisted of the sums of eight thousand pounds consols five thousand pounds 4 per cent consolidated Bank annuities which have been since reduced 3 ¼ percent Bank annuities and two hundred pounds long annuities and on the occasion of such a marriage I appointed a sum of five thousand pounds consols part of the said sum of eight thousand pounds consolidated  Bank annuities unto or for the benefit of my daughter Louisa leaving the sums of three thousand pounds consols five thousand pounds 3 ¼ percent Bank annuities and two hundred pounds long annuities now subject to the trusts of the said settlement and to the power of appointment therein contained And whereas I am desirous that the trust funds as they stood at the time of the making of my said daughters marriage settlements should be equally divided between my three children Louisa Thomas & Charles now I the said Thomas Abraham do hereby in exercise and execution of every power enabling me in this behalf direct and appoint that from and immediately after my decease each of my said sons Thomas and Charles shall receive from and out of the said remaining trust funds of five thousand pounds 3 ¼ percent Bank annuities three thousand pounds consols and two hundred pounds long annuities such part or such sums of money as will according to the value of stocks on the day of my death be equal to the value or price of five thousand pounds 3 per cent consolidated Bank annuities and I do further direct that in case there shall remain any part of the said trust funds of five thousand pounds 3 ¼ percent Bank annuities three thousand pounds consols and two hundred pounds long annuities after the transfer or payment to each of my said sons of such part thereof or such sums of money thereout as will be equal to the value of five thousand pounds consols on the day of my death then that sum residue of the said remaining trust funds shall be equally divided between my said three children Louisa Thomas and Charles share and share alike and I hereby revoke every direction and bequest inconsistent with this codicil in witness whereof I have hereunto set my hand this 12th day of December in the year of Our Lord 1845 – Thos Abraham Chapel House Frimley Surrey – signed and published by the said testator in the presence of us the undersigned – Alfred Goddard Frimley – William Crooks Frimley

 

Appeared personally William Crooks of Frimley in the County of Surrey coal merchant and made oath that he is one of the subscribed witnesses to the codicil to the last will and testament of Thomas Abraham formerly of the Royal military College Sandhurst in the County of Berks and late of Frimley aforesaid Esquire a retired Captain from her Majesty’s Army decease who died on the fifth day of this present month of April the said codicil now hereunto annexed bearing date the 12th day of December in the year of Our Lord 1845 and he further made that on the twelfth day of December one thousand eight hundred and forty five aforesaid the said testator only executed the said codicil by signing his name as the foot or … thereof in the presence of him the deponent and of Alfred Goddard the other subscribed witness thereto both of whom to witness were present at the same time and this deponent and the said Alfred Goddard thereupon attested and subscribed the said codicil in the presence of the said Testator And referring to the writing on the back of the said codicil to which the initials of the said deceaseds name appear to be subscribed he further made oath that the said deceased did not so subscribe the initial letters of his said name in the presence of him the deponent and of the said Alfred Goddard his fellow witness to the said codicil at the time he the said Testator executed such codicil nor did either he the deponent or the said Alfred Goddard of whom he has made enquiry see the said writing at the back of the said codicil at the time of such execution – William Crooks – on the twenty sixth day of April one thousand eight hundred and forty seven the said William Crooks was duly sworn to the truth of this affidavit before me –W.C. Proved at London 4th June 1847 before the worshipful William Calverley Curteis, Doctor of Laws & Surrogate by the oaths of the Reverend Thomas Edward Abraham clerk and the Reverend Charles John Abraham clerk the sons of the Executors to whom admon was granted having been first sworn to administer.
